Town of Raymond Planning Commission Meeting Minutes July 15, 2008 1.) Roll Call: Commissioner Boldt called the meeting to order at 7:00p.m. Present were Commissioners Strohmeier, Boldt, Flasz, Colsmith and Sinda. Also present was Town Engineer Chris Stamborski of R.A. Smith National and approximately twelve (12) residents. 2.) Approval of Previous Minutes: July 1, 2008 – Commissioner Colsmith moved, seconded by Commissioner Sinda to approve as presented, carried 4/0. Commissioner Flasz was not present at this time to vote on the minutes. 3.) Public Comment – for items not listed on the agenda: None. 4.) Public Comment – for items listed on the agenda: Resident Joe Pohlhammer made a recommendation that the soil for the Kawczynski development should stay on site and they should make a swale to hold the water back that comes from the east under 76th street to hold it on the development. Resident Sharon Korponai questioned the Yenter property. 5.) Building Permits Robert & Jeanne Wilks, 3969 108th Street – New Home Commissioner Boldt moved, seconded by Commissioner Flasz to approve as presented and that all Racine County’s rules requiring old homes to come down within 30 days of occupancy be followed, carried 5/0. Steve Schaefer, 8224 W. 6 Mile Rd. – After-the-Fact above Ground Pool Commissioner Boldt moved, seconded by Commissioner Strohmeier to approve with the conditions that the double permit fees be paid, carried 5/0. 6.) Land Disturbance Permit Gary A. Sadler for Monjour Properties, 2713 W. Nicholas St. Mr. Sadler stated that the excess water will run through a grass area first and will be slowed down and filtered out. Commissioner Strohmeier moved, seconded by Commissioner Colsmith to approve as presented and that all the recommendations set forth by the Town Engineer be followed, carried 5/0. Tom Lojeski, 10608 W. 2 Mile Rd. – Adjustment to Previous Permit Commissioner Flasz suggested Mr. Lojeski hire a test firm to test the soil compaction where the house will eventually go. Commissioner Colsmith moved, seconded by Commissioner Strohmeier to approve as presented and that all recommendations of the Town Engineer be followed, carried 5/0. Bill Zach, Lots 7 & 8 – Stone Creek Crossing Commissioner Boldt moved, seconded by Commissioner Sinda to approve as presented and that all recommendations by the town engineer be followed, carried 4/1. Commissioner Flasz opposed because he does not like the way it came about that it needs to be done. K Custom Homes Development, 76th Street – Discussion/Possible Decision on Need for Soil Disturbance Permit Commissioner Flasz moved to have Mr. Kawczynski come in and petition to take the top soil off the site and discuss other issues related to the development including erosion control, seconded by Commissioner Strohmeier, carried 4/0. Commission Colsmith abstained. Jim Stack for 915 92nd St. – Discussion/Possible Decision on Citation Amount It was discussed that Mr. Stack should be fined for each day in violation until July 10, 2008 and to review what the normal fine in cases like this one usually is. Engineer Chris Stamborski stated that the Planning Commission should ask what the base would be to cover the legal and engineering fees. Commissioner Colsmith moved, seconded by Commissioner Sinda to hold over until the commission receives options from the town attorney, carried 5/0. Pilo & Veronica Sanchez, 915 92nd St. – Discussion/Decision on Drafting Letter to Send to Court for Citation The planning commission will have Clerk Morgan type the draft letter and put it in a more formal setting to be sent to Atty. Chris Geary. The letter is as follows: The Sanchez’s have been conscientiously working with the Town to get this issue resolved and the Planning Commission would like to grant leniency in regarding to the citation; however, they do feel some monetary restitution should be received due to the fact that the Sanchez’s do bare some responsibility by paying all attorney and engineering fees and court costs and a minimum of $500.00 in fines.
7.) Revised CSM – K Custom Homes Development – 76th Street Discussion/Possible Decision on Requirement of Revised CSM including Soil Borings: The planning commission decided to hold this over until Mr. Kawczynski wants to come in and discuss this with them. 8.) Minor Land Division/Waiver Request Roger Gullikson, 11906 Hwy. K – Waiver to divide 18.25 acres with 360 feet of frontage into two parcels of 9.25 acres and 9.0 acres Commissioner Colsmith moved to hold over until they get legal notice of a lot being created with a 32’x54x outbuilding on it without a house as well. After some discussion, Commissioner Colsmith withdrew his motion. Commissioner Sinda moved, seconded by Commissioner Strohmeier to deny the request because there is not enough road frontage and creating an unaccompanied agri-building on an outlot, carried 3/1. Commissioner Colsmith opposed and Commissioner Flasz abstained. 9.) Stormwater Management User Fee Ordinance for the SWUD Discussion/Possible Decision to sent to Town Board Commissioner Boldt moved, seconded by Commissioner Colsmith to send the ordinances to the board for final app4roval and to adopt into an ordinance, carried 5/0. 10.) Correspondence/Discussion: Commissioner Flasz told the planning commission that the Town Board put the sump pump ordinance on hold. Commissioner Flasz requested an update on the Urban property. Commissioner Boldt stated that he stopped at the Urban property and saw no wrong doing. 11.) Approval of Previous Minutes: June 17, 2008 – Commissioner Flasz stated that he had an amendment to the minutes which reads as follows: “Due to the length of discussion regarding the Sanchez issue, not all discussion was entered into the meeting minutes, however, Commissioner Flasz recorded the entire meeting.” Commissioner Colsmith stated that item 10 should read “Commissioner Colsmith was contacted about the Tim Yenter property to see if he was overfilling.” Commissioner Colsmith moved, seconded by Commissioner Flasz to approve the minutes as presented, carried 4/0. Building Permits Justin Furnance for the Ray Family, 348 49th St. – New Home Commissioner Boldt moved to approve as long as they follow all of the Town Engineers recommendations, seconded by Commissioner Colsmith, carried 5/0. Keith Kobiella, 4123 108th St. – 26’x40’ Accessory Building Keith was asked if it was for personal use only. He stated that it was. Commissioner Colsmith moved to approve as presented, seconded by Commissioner Boldt, carried 5/0. 6.) Land Disturbance Permit Steve Puschnig, 10325 W. Hwy. G – Robie of Robie’s Grading stated that he is in no hurry to get it done and that it might also take another 8,000 yds. to complete the job. Commissioner Boldt moved, seconded by Commissioner Strohmeier to approve as long as they follow the town engineer’s recommendations, carried 5/0. 7.) Set Date for Joint Meeting with Town Board & Veronica & Pilo Sanchez – 915 92nd St. Commissioner Boldt moved, seconded by Commissioner Strohmeier to hold a joint meeting with the Town Board on July 10, 2008 at 7:30p.m. at 915 92nd Street, carried 5/0. 8.) Bond Issues: Discussion/Possible Recommendation to Town Board: Commissioner Strohmeier moved to hold over until the commission has a bond agent come in and present more information, seconded by Commissioner Flasz, carried 5/0. Commissioner Flasz will try to get somebody to come and talk to the commission. 9.) Road Issues for Subdivisions - Discussion/Possible Recommendation to Town Board: The commission decided to hold over to ask Clerk Morgan to find out what neighboring municipalities do with their subdivisions (Franklin, Oak Creek, Yorkville & Caledonia). 10.) Ordinance Review/Recommendation Related to Surface water run-off & Ground Water Discharge for New Construction - Discussion/Possible Decision to Send to Town Board: Commissioner Flasz moved to pass the version dated May 20, 2008 on to the Town Board from the Stormwater Drainage Commission. The Town Board can pass it on to the Town Attorney to put into ordinance form or whatever they decide. Seconded by Commissioner Colsmith, carried 3/2. Commissioner Strohmeier and Sinda opposed. The Planning Commission also decided when the stormwater drainage commission has anything to come before the planning commission that one member of the drainage commission must be present to explain their intentions on an issue so the Plan Commission can ask questions or it will not be addressed. 11.) Correspondence/Discussion: It was brought up that Sean Snyder is concerned about a neighbor’s soil disturbance. Discussion about having the Town Engineer check the Yenter soil disturbance took place. Commissioner Flasz brought up K- Custom Homes and they will try to get him on an upcoming agenda for a soil disturbance permit. 11.) Town of Raymond Planning Commission Meeting Minutes June 17, 2008
1.) Roll Call: Commissioner Boldt called the meeting to order at 7:00p.m. Present were Commissioner Boldt, Flasz, Colsmith and Sinda. Commissioner Strohmeier was absent. Also present was Attorney Elaine Ekes of Hostak, Henzl & Bichler, Town Engineer Chris Stamborski of R.A. Smith National, and approximately twelve (12) residents. 2.) Approval of Previous Minutes: June 3, 2008 – Commissioner Flasz abstained. Commissioner Colsmith moved, seconded by Commissioner Sinda to approve the minutes as presented, carried 3/0. 3.) Public Comment – for items not listed on the agenda: A neighbor questioned if a soil disturbance permit was needed for 10711 W. 7 Mile Rd. Resident Pohlhammer questioned Commissioner Boldt if copies of his concerns were given to Commissioner Flasz. 4.) Public Comment – for items listed on the agenda: None 5.) Land Disturbance Permit(s) Pilo & Veronica Sanchez, 915 92nd St. – Discussion w/Town Engineer & Attorney and decision on how to proceed with current Stop Work Order, Citations, and any other issues related to this matter: Atty. Ekes gave an update of where we are with this issue to date. Commissioner Colsmith went to the Sanchez property on June 10, 2008 to look for drain tile. Commission Colsmith could not say for sure if the drain tile exists. Atty. Ekes stated that this is now a policy issue. Atty. Ekes stated the ordinance was violated. Eng. Stamborski stated there is more fill so the water took a different route. Commissioner Flasz questioned Mr. John Kashin why they brought in more fill then the original grading plan called for. Mr. Kashin stated the Sanchez’s told him that it looked nice so they continued to have more fill brought in. Eng. Stamborski stated they were still bringing in fill on May 9, 2008 when R.A. Smith was doing the survey. Commissioner Flasz questioned why they didn’t set grades-grade stakes. Mr. Kashin stated they hardly ever set grades. Mrs. Sanchez stated the front looks fine but the sides need work. Commissioner Colsmith feels that all 6,400 extra yards should come out. Mrs. Sanchez stated if the Planning Commission wants all 6,400 yards out then she wants a joint meeting with the Town Board and the Planning Commission. Atty. Ekes stated if the entire fill is to be taken out it could cost the town a lot of money upfront. Atty. Ekes stated if a compromise could be worked out that would be better. Atty. Ekes stated the notice of intent was filed so the Sanchez’s are receiving daily fines. Mr. Kashin stated the Planning Commission should just fine the Sanchez’s and let them keep the fill. Commissioner Flasz would like to see two proposals. The first proposal to include the grading plan showing the town engineer that it will work and the second proposal showing the 3,000 yards removed. Eng. Stamborski stated there is a 5 foot height difference for the west side of the property to the east side. Commissioner Boldt motioned to have a revised grading plan submitted with a 4 to 1 slope and the swales to show a positive drainage, to haul the fill away for making the 4 to 1 slope and to also have Commissioner Sinda be the contact person to check the field tile and put on the next agenda, seconded by Commissioner Sinda. Motion carried 3/1. Commissioner Colsmith opposed do to this agenda item was done at 8:25p.m. Steve Puschnig, 10325 W. Hwy G: Robbie from Robbie’s Grading asked to hold over since Eng. Stamborski was not able to review. Agenda item held over. 6.) Building Permits George Slattery, 6445 W. 3 Mile Rd. - 32’x50’ Detached Garage: The planning commission asked George if it was for personal use. Yes, replied George. Commissioner Sinda moved, seconded by Commissioner Flasz to approve as presented, carried 4/0. Justine Furnace for the Ray Family, 348 49th St. – New Home: There was discussion about the water issue on the property. Two neighbors showed pictures of the water. Commissioner Boldt motioned to hold over and have the Town Engineer look into and make recommendations at the next planning meeting on July 1, 2008. Agenda item held over. Scott & Coleen Urban, 9316 W. 5 Mile Rd. – New Home & Pole Shed 60’x 80’ for personal use only: Commissioner Boldt moved, seconded by Commissioner Sinda to approve as presented with the stipulation that if more fill is brought in the Planning Commission will place a stop work order for the property. Motion carried 4/0. Steve Kramer, 3950 W. 3 Mile Rd. – Free Standing Screen Porch: This item did not need to be on the agenda per discussion from previous meeting. 7.) Cemetery Ordinance – Review, Discussion, Possible Decisions on Input to send to Town Board: Commissioner Colsmith motioned to pass on to the Town Attorney first to put into ordinance form and then have the Town Board review for adoption, seconded by Commissioner Boldt, carried 4/0. 8.) Bond Issues – Discussion/Recommendations to send to Town Board: Commissioner Boldt motioned to hold over do to it was getting late, seconded by Commissioner Sinda. Motion carried 4/0. 9.) Planning Commission Procedural Changes - Discussion/Possible Decision on Information provided by Commissioner Colsmith: After a little discussion Commissioner Colsmith decided to drop it. 10.) Correspondence/Discussion: Commissioner Colsmith mentioned he received a phone call for property on 2562 96th St. with regards to the fill quantity. Commissioner Colsmith had inquired about the property on 5224 Hwy G. 11.) 1.) Roll Call: Commissioner Boldt called the meeting to order at 7:00p.m. Present were Commissioner Boldt, Strohmeier, Colsmith and Sinda. Commissioner Flasz was absent. Also present was Town Board Chairman Gary Kastenson and approximately ten (10) residents. 2.) Approval of Previous Minutes: May 20, 2008 – Commissioner Colsmith moved, seconded by Commissioner Strohmeier to approve the minutes as presented, carried 4/0. 3.) Public Comment – for items not listed on the agenda: None 4.) Public Comment – for items listed on the agenda: Resident Bill Boyce apologized for being late when the Planning Commission came to his home to discuss the soil disturbance issue. He also thanked the Planning Commission. Resident Steve Kramer requested to speak during the Correspondence/Discussion portion of the meeting. The Planning Commission agreed to this. 5.) Building Permits Daniel Woeckner, 9209 W. Hw3y. G – 24’x38’ Pole Barn: Commissioner Boldt moved, seconded by Commissioner Sinda to approve as presented, carried 4/0. Amended Zoning Permit Sandra & Donald Gibbs, 12121 W. 5 Mile Rd. – Moving building 18 feet per amended zoning permit. Commissioner Sinda moved, seconded by Commissioner Strohmeier to approve contingent that they get the silt fence up for erosion control, carried 4/0. 7.) Land Disturbance Permit(s) David & Julie Anderson.7550 W. 3 Mile Rd. – Commissioner Colsmith moved, seconded by Commissioner Strohmeier to approve as long as they follow the conditions set forth by R.A. Smith, carried 4/0. Jim Stack for Pilo & Veronica Sanchez, 915 92nd Street – Neither Jim Stack or the Sanchez family was present. Commissioner Colsmith moved that the Planning Commission require the property owners to remove the 6,400 cubic yards that went over the original grading plan that was approved in November 2007. Commissioner Sinda seconded the motion. After further discussion involving feelings that the Sanchez’s were playing the Planning Commission and realization that Commissioner Boldt would have to rescind his motion from the May 20, 2008 meeting which was to hold the issue over until the June 3, 2008 meeting to allow the Sanchez’s and Mr. Stack to bring in a revised plan and re-apply for the soil disturbance permit. Commissioner Boldt moved to rescind, seconded by Commissioner Strohmeier. Motion to rescind carried 4/0. Commissioner Colsmith moved that the Planning Commission require the additional 6,400 cubic yards from the original grading plan that was approved in November 2007 be removed from the site, seconded by Commissioner Sinda. Motion carried 4/0. Commissioner Colsmith stated that because of past statements made by the homeowner and Mr. Stack that they have moved five feet of topsoil gives the Planning Commission reason to believe that the field tile running through the property has been disrupted. Various members of the commission have been told by neighbors and farmers that work the neighboring land that there is field tile running through that property. Based on the above statements, Commissioner Colsmith moved that the Sanchez’s have 14 days from notification to call the Town Clerk to arrange for a Planning Commission member to come to their property to see if water is running in the tile. The Sanchez’s are required to dig the tile up on their east and west side of their property so it can be inspected. Commissioner Sinda stated that he would inspect the tile when notified. The motion was seconded by Commissioner Strohmeier. Motion carried 4/0. Commissioner Colsmith moved to have the DPW look at the culvert under their driveway to see if it could be repaired or needs to be replaced, seconded by Commissioner Boldt, carried 4/0. Commissioner Colsmith moved to fine the contractor a daily citation of $500 with the acknowledgement that the commission could go back to the May 13, 2008 date. Commissioner Strohmeier seconded the motion, carried 4/0. Commissioner Colsmith moved to have the daily ongoing citations to the Sanchez’s to accumulate until the issue is resolved, seconded by Commissioner Sinda, carried 4/0. 10.) Shoreland Contract Scott & Coleen Urban, 9616 W. 5 Mile Rd.: Commissioner Boldt moved, seconded by Commissioner Strohmeier to approve as presented, carried 4/0. 11.) Lot Line Adjustment Bill Zach, Lots 7 & 8 in Stone Creek Crossing Development: Commissioner Boldt moved, seconded by Commissioner Colsmith to approve as presented, carried 4/0. 12.) Request from Public Joe Pohlhammer, 2135 76th Street – Request for Discussion/Possible Decision on Stop Work Order for K Custom Homes Development for failure to follow Ordinances & Requirements of R.A. Smith without Waivers: Joe Pohlhammer stated that he was taping the discussion. Commissioner Strohmeier requested Mr. Pohlhammer be specific on what is being done wrong. Mr. Pohlhammer could not e anymore specific. Commissioner Boldt stated that it is always the same thing and Joe is trying to waste everybody’s time and town money. Commissioner Boldt moved, seconded by Commissioner Strohmeier to drop this issue dead, carried 4/0. 13.) Input/Informational Patrick Konkol for Indvest, 4134 Courteney St. – Installation of 4’x8’ Sign: This was just to inform the town that they are installing a 4’x8’ ground sign with no electric. 14.) Correspondence/Discussion: Discussion took place regarding allowing building inspector Lee Greivell to issue a building permit for a gazebo to Steve Kramer. A consensus of the commissioner will allow Lee to issue the permit since they d not come before the commission anyway. The Planning Commission will check to see if there needs to be a soil disturbance permit for 10711 W. 7 Mile Rd. Cemetery Ordinances will be placed on the June 17, 2008 meeting agenda for review as well as the issue of requiring contractors to put up a bond to do work in the town. 15.) 1.) Roll Call: Commissioner Boldt called the meeting to order at 7:00p.m. Present were Commissioner Boldt, Strohmeier, Flasz, Colsmith and Sinda. Also present was Town Engineer Chris Stamborski of R.A. Smith National and about twelve (12) residents. 2.) Approval of Previous Minutes: May 6, 2008 & May 12, 2008 – Commissioner Strohmeier moved, seconded by Commissioner Flasz to approve both set of minutes as presented, carried 5/0. 3.) Public Comment – for items not listed on the agenda: None 4.) Public Comment – for items listed on the agenda: None 5.) Land Disturbance Permit Jim Stack for Pilo & Veronica Sanchez, 915 92nd Street – Discussion/Possible Decision on Citation and Progress on Rectifying Non-Compliance: Engineer Chris Stamborski stated that the silt fence needed to be installed in front and along the whole south side. He also mentioned that there was 6,400 cubic yards more soil brought in than what the original grading plan called for. Jim Stack explained that the soil disturbance permit was filed for 20,000 yards. The biggest issue discussed was that the grading plan was not followed. John Kashin of Stack Grading stated that he and Mr. Stack were wrong for not following the grading plan but that the yard looks good. Engineer Stamborski stated that the extra fill could work. Commissioner Colsmith moved to place a $500 per day fine until the violation is corrected. Motion died for lack of a second. Commissioner Boldt questioned Engineer Stamborski if he was sure that the extra fill would work. Engineer Stamborski replied that it would work with some modifications of getting the slope on the south side to a 4:1 ratio and installing the silt fence right away. Engineer Stamborski explained that it is ultimately up to the planning commission to determine what disciplinary action to take. John Kashin stated that there should be a little more fill brought in but the Planning Commission does not want anymore to be brought in. Commissioner Boldt questioned Mr. Kashin if he would be willing to use the backhoe on site to get the 4:1 slope on the south side. Mr. Kashin stated that he would. Engineer Stamborski reiterated that the only work that can be done at this point is for the silt fence to be installed. Commissioner Flasz moved that they have the opportunity to submit a revised plan and if they choose not to do that, then they will be sent to the town board. Commissioner Boldt stated that the planning commission handles the soil disturbances and Engineer Stamborski also explained that the soil disturbance is a planning commission issue. Commissioner Flasz rescinded his motion. Commissioner Boldt moved to hold over until June 3, 2008 so that they can bring in a revised plan and re-apply for the soil disturbance permit, seconded by Commissioner Strohmeier, carried 5/0. 6.) Conditional Use Gary A. Sadler for Monjour Properties (Norco Manufacturing) – To Construct a 20’x25’ Masonry Addition and Outside Storage Area with Overhead Crane (75’x128’): Commissioner Flasz stated that he was going to abstain from voting. Commissioner Colsmith moved, seconded by Commissioner Strohmeier to approve the conditional use and have them come up with a storm water run-off plan for when they come back for the building permit. Motion carried 4/0. 10.) Variance(s) Daniel Woeckner, 9209 Hwy. G – 912 sq. ft. Pole Shed (24’x38’) on 1 acre lot: Commissioner Boldt questioned Mr. Woeckner if the pole shed was for personal use. Mr. Woeckner replied that it was. Commissioner Flasz abstained from voting. Commissioner Sinda moved, seconded by Commissioner Strohmeier to approve as presented. Carried 4/0. 11.) Mr. Moczynski work with the DPW & Fire Department on the drive and loading area for the fire truck (water tanker), 2.) Have the Town Board direct the DPW to document all stone and fill installed for the drive and loading area and observe the techniques during construction, 3.) Provide a profile of the pond to be kept on file in the town office and 4.) The Town board waives the engineer review. Commissioner Colsmith abstained. Motion carried 4/0. Minor Land Division & Waiver Request Bob Flasz, 10000 W. 3 Mile Rd.: Commissioner Flasz stepped down to present his case. He stated that he would like to have a house built for his mother-in-law and a house for his sister-in-law since she is the primary caregiver for Mr. Flasz’s mother-in-law. He is applying for a waiver because the mother-in-law wants to have her own independence, but she needs someone close to her to keep an eye on her. Commissioner Strohmeier told Mr. Flasz that this could lead to anyone that has more acreage without the road frontage required applying for medical hardships. Mr. Flasz stated that precedence has already been set. Commissioner Colsmith moved, seconded by Commissioner Sinda to deny the waiver based on the material presented. Commissioner Strohmeier abstained. Motion carried 3/0. 11.) Ordinance Review/Recommendations/Approval Ordinance 2008-03 for the Amendment of Article VI of Chapter 26: Commissioner Colsmith mentioned to that town’s attorney that in 26-484 the word “pat” should read “part.” He also pointed out that in 26-188 the heading is missing. Atty. Geary stated that both of these can be changed. The Planning Commission, Town Attorney and Town Engineer reviewed the changes to the draft as well as those provided by Wally Madsen. They decided to recommend incorporating item #3 only of Mr. Madsen’s suggestions. Commissioner Colsmith moved, seconded by Commissioner Boldt to approve the draft with the one addition being item #3 on Mr. Madsen’s suggestions and send to Town Board for final approval, carried 5/0. 12.) Land Disturbance Permit Sanchez, 915 92nd Street – Review & Possible Stop Work Order: Engineer Stamborski stated that he stopped by the property and said it looked as though it was going according to the grading plan that was approved by the Planning Commission. Commissioner Flasz moved, seconded by Commissioner Strohmeier to direct the Clerk to send a letter to the Sanchez’s and Jim Stack stating that they are on notice that they follow the grading plan that was previously approved and recommend to have the Town Board send the DPW to this address to dig in the ditch under or at the end of the culvert to see if there is a drain tile coming from the property and determine if it is still working, carried 5/0. 13.) Correspondence/Discussion: Discussion was held to notify the Town Board that there had been top soil taken away from K Custom Homes to see if the board wants to take action. The Planning Commission suggested Pat be placed on the Town Board’s agenda to possibly waive the engineer review, pond or soil disturbance fee. Correspondence/Discussion: Commissioners Kastenson and Flasz gave a brief summary of the joint meeting of the Planning Commission, the Town Board and Drainage Commission. The Drainage Commission was trying to raise needed money. The ERU method would charge businesses by the square foot of impervious surface. Agenda Items for Discussion/Possible Decision: Item 1) Additions to previously approved Planning Commission Meeting Minutes dated December 4, 2007. Commissioner Flasz had been in favor of his amendments but was in minority 3/1. Item 2) Procedure for cancellation or date changes for Planning Commission Meetings - Commissioner Flasz questioned why a public meeting would be cancelled, the discussion was heated. Commissioner Boldt stated that when there are no items on the agenda there wasn’t any reason to meet and that is what had been done in the past. Commissioner Flasz took the position that a public meeting shouldn’t be cancel ever. Commissioner Boldt finally stated he would not cancel any more meetings but it would be stupid to meet with nothing to do. Item 3) Procedure for deadlines/timeliness of submitting minutes to the Town Board for meeting and Planning Commission for approval. Commissioner Boldt pointed out that the Town Board and other Planning Commission members had not complained but if someone else wanted to take minutes and be secretary they were welcome to it. None of the members wanted the job. After much more heated discussion. Commissioner Ziemer motioned to stop the discussion and move on. Seconded by Commissioner Strohmeier motion carried 4/0. Item 4) Possible adoption of an ordinance related to sump pump discharge from homes. The Commission decided to holdover and to ask the Town Clerk to again ask other municipalities what they had. Chris Stamborski offered that any would most likely be about discharge into sanitary sewers. Commission will re- visit this again after more information was made available. Discussion/Possible Decision: What are needed recommendations for changes to Soil Disturbance Ordinance and Erosion Control Checklist. Commissioner Ziemer had made a draft for a possible new checklist and the Commission had made one change to line 2 of this draft. Commissioner Ziemer motioned to have Kari review it also for her input, if no changes were needed to have it sent to the Town Board. Seconded by Commissioner Strohmeier, motion carried 4/0. A letter was received from the Town Attorney in response to a conversation with Gary Boldt and the recommended changes to make on the Ordinance should be reviewed. Culvert and Driveway Permit process - The Commission decided to hold over until the Ordinance Committee submits their proposal. The Ordinance Committee has been working on this matter. Soil Disturbance After the Fact: James Stack for Veronica Sanchez – 915 92nd Street – The Town Engineer - Chris Stamborski stated – The March CSM was not the one he had seen. The grading plan he said must maintain the water runoff from West to East and proper erosion control has to be put in place as required by Town Ordinance including new swales and hay bales for ditches. Chris also said any grading plan must not cause standing water on other properties. He will be in charge of monitoring and approving erosion control before any grading is to start. Commissioner Boldt asked how much fill was brought in to date. Jim Stack said there was about 2500 cubic yards; his partner said that some more would be needed to finish the grading. Commissioner Boldt motioned to approve the Soil Disturbance Permit when all erosion controls are in. This must be done within 10 days and approved by Chris Stamborski. The required $500 fee is to be paid and all the recommendations of the engineer must be completed. Chris will check the water runoff as well as monitoring of possible field tile damage. Veronica Sanchez and Jim Stack were warned that if erosion controls are not in place after the 10 days, legal action and possible fines might result. Commissioner Strohmeier seconded motion. Stop Work Order to owner that immediately all erosion measures must be done per Town Ordinances within 10 days or fines and penalties could result. Bob was questioning Chris about the road height and pond being too close. He suggested that road heights should be 2 feet higher for water runoff. Commissioner Ziemer thinks the check off list for building permits needs to be changed, requests it to be placed on next agenda. He also feels that municipal fines be imposed. He requested a joint meeting of Town Board, Planning Commission and Building inspector be setup to discuss possible problems. Commissioners Flazs and Ziemer think that contractors working in town should sign an affidavit that they will follow all ordinances and best practices. The Town Engineer disagreed and cautioned that the town might have a liability issue. The first meeting in January will be on the second. Joe feels this is unacceptable and a report should have been made when the field tile was disturbed and not later. Correspondence/Discussion: Commissioner Ziemer stated that he feels that contractors are taking advantage of the Commission and are treating/talking to us like we are a bunch of "hicks" in Raymond. He feels we need to do more to be able to "punish" more for malicious violations such as contractor Stack appears to have done. The ordinances need to have more "teeth" in them from the Town Board. The Board should put approate fines and restitutions into the ordinances. Also the neighbors should be informed when a stop work order has been placed noting the problem. Sending problems to R A Smith and them approving but not appearing before the Commission to discuss/review their recommendations with us bother Commissioner Flasz.
